Terms of Service

Overview 

This website is operated by Mick's Art Shop (Mick O'Driscoll) . Throughout the site, the terms “we”, “us” and “our” which refers to Mick's Art Shop. Mick's Art Shop offers this website, products, including all information and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein. These 'Terms of Service' apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Section 1 - Payment

1.a Once an order (commission) has been completed payment for the piece will be required in full and is non-refundable, unless an agreement has been reached by the buyer and Mick’s art shop or the artwork is damaged in transport and is insured.

All payments to be made in GBP.

1.b Banking charges by the receiving bank on payments to us will be borne by us. All other charges relating to payment in a currency other than pounds Sterling will be borne by you.

1.c We accept credit and debit card payments through our website and we also accept Paypal. 
 

Section 2 - Prints

2.a Prints are not "Exact" replicas of paintings, this means that the colours or organisation of the piece may not be entirely true to the original.

2.b Every piece of art created by Mick O’Driscoll will be signed in some capacity, if you're unhappy with where the signature is unfortunately we cannot supply another piece so please study the painting before purchasing.

 

Section 3 - Quality Of Art

3.a A customer may request an original or a sketch to be changed, however, Mick O’Driscoll reserves the right to deny the request with a state reason or otherwise whether a piece of artwork is completed or still in progress.

3.b All art work completed by Mick's Art Shop is a true intention of the artistic work made by Mick O'Driscoll and contains no defects (this includes on canvas, prints, posters, digital photos and any other printed works).

At Mick’s Art shop we’re committed to delivering high quality work, therefore if something isn't quite up to scratch please get in contact with us ASAP to discuss.

Section 4 - Insurance

4.a  All paintings sent by post are insured, so any damage caused to the paintings in transit will be reimbursed by the shipping company. All you have to do is contact us within 24hrs and take the damaged photos and send them to me by email, I'll take care of the rest.

 

Section 5 - Information You Give Us

5.a You agree that you have provided, and will continue to provide accurate, up to date, and complete information about yourself. We need this information to provide you with the Goods.

5.b We will use our reasonable endeavours to respond to any point of dissatisfaction by you, provided you contact us within 14 days of purchase.

5.c Prices for delivery may already be quoted online but enquiries for delivery quotes can be made to the artist via the enquiry system.

 

Section 6 - Artwork Received Damaged

6.a All artwork sent will be fully insured against damages and it is the artist's responsibility for it to arrive safely to you. Should you receive your artwork damaged, please notify us within 24 hours of delivery and send photos of the damages to: mick.odriscoll@virginmedia.com.

Please advise us if you would like:

- A full refund 

- A replacement (if available)

6.b I may arrange to collect the artwork, or will just request photos to begin a claim with the courier. In this latter circumstance, we ask you keep the artwork and all packaging for a period of 30 days as some couriers will request inspection before a claim can be made.

Section 7 - Returns and Refunds

When returning goods for whatever reason the goods should be

7.1 Returned in the packaging they were sent and the goods in their original condition. 

7.2 securely wrapped.

7.3 with the correct address which will be supplied upon request.

7.4 at your risk and cost unless, otherwise agreed by Mick’s art shop. 

7.5 After I have received the goods, we will credit your credit or debit card with the full purchase price of the goods returned no later than 14 days from the date of receipt.

7.6 If you do not return the goods to us, you are still liable to us for the cost.

7.7 We are under no obligation to collect or recover goods from you, but if we do, our costs will be payable by you.

7.8 If the goods returned are damaged in transit then it is your responsibility to recover the costs from your courier, insurance is recommended to the cost of the goods.

7.9 Buyers are responsible for any customs and import taxes that may apply. I'm not responsible for delays due to customs.

If you have any problems with a delivery, any questions about your paintings or you are not happy with your order for any other reason - just contact us, we will solve any problem!

Section 8 - Shipping & Delivery

8a. Our shipping fee is flat fee of £15 per canvas. (Prices may differ depending on products) 

8.b Standard delivery is 2 - 5 business days after purchase is completed and please accept that deliveries might be delayed due to circumstances out of our control but we will always notify you of any changes, disruptions or delays.
